A judge at the , , has directed that a case filed by a boda boda rider against , the Governor of , be heard in Nairobi.

The petitioner, , moved to court through city lawyer , arguing that his life is in danger and that key government agencies involved in the matter are based in the capital. Among those listed in the case are the and the .

Omari told the court that his client has allegedly faced threats and had difficulties accessing medical care in Busia, forcing his transfer to for treatment.

“The petitioner’s life is being threatened, and he was denied medical attention in Busia before being brought to Nairobi for treatment after the alleged assault,” said Omari.

According to court documents, Yusuf Suleiman Hamisi, a 31-year-old boda boda rider, was allegedly attacked while standing in a queue during the distribution of certified maize seeds.

The petitioner is seeking KSh 100 million in compensation for injuries he claims were inflicted during the alleged incident.

“We shall be seeking damages amounting to KSh 100 million from the governor for attacking our client and violating Chapter Six of the Constitution,” Omari added.

In addition, Yusuf is calling for the impeachment of Governor Otuoma, arguing that the alleged act—reportedly involving an assault to the groin area—was not only unlawful but also culturally offensive, particularly within the Luhya community.

The case is expected to proceed in Nairobi as investigations and legal processes continue, with attention likely to focus on both the alleged assault and broader questions of leadership and accountability under Kenya’s constitutional framework.
